1. Acceptance of Terms
Welcome to Jaikisan Marketplace. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all users of the platform, including customers (buyers), vendors (sellers), and visitors.
2. About Jaikisan
Jaikisan is an online marketplace that connects farmers and agricultural vendors directly with consumers. We provide a platform for buying and selling farm-fresh products, with unique delivery options including Bus Parcel Delivery service.
Important: Jaikisan acts as an intermediary platform. We do not own, produce, or handle the products sold. All transactions are between buyers and vendors.
3. User Accounts
3.1 Registration
- You must provide accurate and complete information during registration
- You must be at least 18 years old to create an account
- Phone number verification via OTP is required
- You are responsible for maintaining the confidentiality of your account
3.2 Account Responsibilities
- You are responsible for all activities under your account
- Notify us immediately if you suspect unauthorized access
- Do not share your account credentials with others
- One person should maintain only one account
4. For Farmers
4.1 Farmer Registration
- Farmers must provide accurate business information
- Farmer accounts require admin approval
- Aadhaar verification may be required for enhanced trust
4.2 Product Listings
- Products must be accurately described with clear photos
- Prices must be fair and clearly stated
- Stock availability must be kept updated
- Only legal agricultural products may be listed
- Prohibited items include: illegal substances, hazardous materials, counterfeit goods
4.3 Farmer Obligations
- Fulfill orders promptly and as described
- Maintain product quality and freshness
- Respond to customer inquiries in a timely manner
- Handle returns and complaints fairly
- Comply with all applicable food safety regulations
5. For Customers
5.1 Purchasing
- Review product details carefully before ordering
- Provide accurate delivery information
- Be available to receive deliveries as scheduled
- Make payments as agreed
5.2 Customer Responsibilities
- Inspect products upon delivery
- Report issues promptly (within 24 hours for perishables)
- Communicate respectfully with vendors
- Provide honest reviews and ratings
6. Payments
- Accepted payment methods include UPI, cash on delivery, and bank transfer
- All prices are in Indian Rupees (INR)
- Payment terms are between buyers and vendors
- Jaikisan may charge a service fee or commission on transactions
- Refunds are handled according to our refund policy
7. Delivery
7.1 Delivery Options
- Farmer Delivery: Direct delivery by the farmer
- Bus Parcel Delivery: Using public bus services for affordable delivery
- Self Pickup: Collect from vendor location
7.2 Bus Parcel Delivery Terms
- Delivery times depend on bus schedules
- Customers must collect parcels from designated bus stands
- Jaikisan is not liable for bus delays or schedule changes
- Customers must carry valid ID for parcel collection
8. Returns and Refunds
- Return policies vary by vendor and product type
- Perishable items must be reported within 24 hours of delivery
- Refunds are processed based on the issue and evidence provided
- Disputes are mediated by Jaikisan support team
9. Prohibited Activities
Users must not:
- Provide false information or impersonate others
- Engage in fraudulent transactions
- Harass, threaten, or abuse other users
- Manipulate reviews or ratings
- Attempt to bypass platform security
- Use the platform for illegal activities
- Spam or send unsolicited communications
- Violate intellectual property rights
10. Intellectual Property
The Jaikisan name, logo, and platform design are our intellectual property. Users retain ownership of content they post (product images, descriptions) but grant us a license to display and use it on the platform.
11. Limitation of Liability
Jaikisan provides the platform "as is" and makes no warranties regarding:
- Product quality, accuracy of descriptions, or fitness for purpose
- Vendor reliability or trustworthiness
- Delivery timeframes or bus schedules
- Uninterrupted or error-free service
To the maximum extent permitted by law, Jaikisan shall not be liable for any indirect, incidental, or consequential damages.
12. Termination
We may suspend or terminate accounts that:
- Violate these Terms
- Engage in fraudulent activity
- Receive multiple complaints
- Remain inactive for extended periods
Users may delete their accounts at any time through account settings or by contacting support.
13. Dispute Resolution
Any disputes arising from these Terms shall be:
- First attempted to be resolved through our support team
- Subject to arbitration if informal resolution fails
- Governed by the laws of India
- Subject to the exclusive jurisdiction of courts in India
14. Changes to Terms
We may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms. We will notify users of significant changes via SMS or platform notifications.
